These Terms of Service (“Terms”) govern your use of our website, communications, estimates, and services provided by Allen Shine LLC, doing business as Signature Christmas Lighting (“Signature Christmas Lighting,” “we,” “us,” or “our”).By accessing our website, requesting an estimate, scheduling service, or purchasing services from us, you agree to these Terms.1. Our ServicesSignature Christmas Lighting provides professional holiday and decorative lighting services, which may include:Christmas and holiday light installationCustom-fit roofline and architectural lightingTree, shrub, and landscape lightingWreath, garland, and decorative installationsSeasonal maintenance and serviceRemoval and takedownSeasonal storagePermanent lighting installationOther related lighting and decorating servicesSpecific services, materials, pricing, and project details will be described in the estimate, proposal, invoice, or agreement provided to the customer.2. Estimates and PricingEstimates are based on the information available at the time they are prepared, including property measurements, photographs, site conditions, requested design, materials, and anticipated labor.Unless otherwise stated, an estimate is not a guarantee that additional work outside the stated scope will be performed for the quoted price.Changes requested by the customer, unforeseen site conditions, additional materials, electrical work, access requirements, or work outside the original scope may result in additional charges.3. Deposits and SchedulingUnless otherwise specified in writing, a 50% deposit is required to reserve an installation date and begin preparation of materials.The remaining balance is due upon completion of the installation unless different payment terms are stated in the customer's proposal or agreement.Installation dates may be affected by weather, property conditions, material availability, safety concerns, or circumstances outside our reasonable control. We may adjust installation or removal dates when necessary.4. Customer ResponsibilitiesCustomers are responsible for providing reasonable access to the property and informing us of known hazards or conditions that could affect installation.Customers must provide access to suitable electrical outlets unless otherwise agreed.The customer is responsible for ensuring that electrical systems, outlets, timers, GFCIs, and circuits serving the lighting installation are in safe and functional condition.Signature Christmas Lighting is not responsible for pre-existing electrical problems or failures caused by inadequate electrical infrastructure.5. Installation and Property ConditionsWe take reasonable precautions while working on your property. However, installation may require ladders, roof access, clips, fasteners, extension cords, temporary attachments, or other standard installation methods.Customers acknowledge that normal installation and removal activities involve some inherent risk to landscaping, gutters, roofing, siding, paint, trim, masonry, and other exterior surfaces, particularly when those materials are aged, loose, damaged, improperly installed, or deteriorated.We are not responsible for damage resulting from pre-existing defects or conditions that could not reasonably be identified before work began.6. Lighting MaterialsUnless specifically stated otherwise in writing, seasonal lighting materials supplied as part of our service remain the property of Signature Christmas Lighting.Lighting is custom-fit and prepared for each property and may be stored for future seasonal installations.Customers may not modify, relocate, remove, repair, or allow another contractor to modify company-owned lighting equipment without our authorization.Permanent lighting systems purchased by the customer will be governed by the applicable proposal, manufacturer's warranty, and installation agreement.7. Seasonal MaintenanceFor qualifying seasonal installations, we provide reasonable maintenance during the contracted display season for company-supplied lighting.Customers should notify us if a section of lighting stops functioning or another service issue occurs.Maintenance does not cover damage caused by severe weather, animals, landscaping contractors, construction, customer interference, third parties, electrical problems originating from the property, vandalism, or other circumstances outside our reasonable control. Additional charges may apply in those circumstances.8. Weather and SafetyOur team may postpone or discontinue work when weather or property conditions make installation unsafe.This may include high winds, rain, snow, ice, extreme temperatures, unsafe roof conditions, electrical hazards, or other conditions that present an unreasonable risk.Safety decisions are made at our discretion and may result in scheduling changes.9. Removal and StorageSeasonal Christmas lighting is generally removed after the holiday season according to our removal schedule.Exact removal dates are not guaranteed unless specifically stated in writing.Company-owned lighting and materials may be removed and stored by Signature Christmas Lighting for use during future contracted seasons.Customers should not remove company-owned materials themselves unless authorized by us.10. RenewalsFuture-season pricing and renewal terms will be governed by the customer's applicable proposal or renewal agreement.If a customer has entered into a multi-year agreement, the terms contained in that agreement will control in the event of a conflict with these general Terms.11. Cancellations and RefundsDeposits reserve installation capacity and may also be used for ordering, cutting, preparing, and allocating materials specifically for a customer's property.Because of this, deposits may become non-refundable once materials have been ordered or prepared, scheduling capacity has been reserved, or work has begun, except where otherwise required by law or stated in the customer's agreement.Any cancellation or refund eligibility will be determined according to the customer's specific proposal or agreement and applicable law.12. PaymentPayment is due according to the terms shown on the applicable estimate, invoice, or agreement.Customers are responsible for amounts due for completed work, approved additions, and materials provided.We reserve the right to suspend maintenance, removal, future installation, or other non-required services on accounts with outstanding balances, subject to applicable law.13. Photographs and MarketingWe may photograph completed installations for documentation, portfolio, advertising, social media, or marketing purposes.We will not intentionally publish personally identifying information such as the customer's name together with the property address without permission.Customers who do not want their completed installation used for marketing purposes may notify us in writing.14. Website and Intellectual PropertyWebsite content, photographs, graphics, branding, logos, designs, written materials, and other content owned by Signature Christmas Lighting or Allen Shine LLC may not be copied, reproduced, or commercially used without permission.15. Disclaimer of WarrantiesExcept for warranties expressly stated in a written proposal or agreement, services are provided to the extent permitted by law without additional warranties, whether express or implied.Manufacturer warranties applicable to particular products remain subject to the manufacturer's terms and limitations.16. Limitation of LiabilityTo the fullest extent permitted by applicable law, Signature Christmas Lighting and Allen Shine LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services.To the fullest extent permitted by law, our aggregate liability arising from a particular service will not exceed the amount paid by the customer to Signature Christmas Lighting for the service giving rise to the claim.Nothing in these Terms limits liability where such limitation is prohibited by applicable law.17. Third-Party ServicesOur website or communications may use or link to third-party platforms, including payment processors, scheduling systems, mapping services, social media platforms, analytics providers, and other technology providers.Their services are governed by their own terms and privacy practices.18. SMS and Electronic CommunicationsIf you provide your telephone number or otherwise consent to receive text messages, we may communicate with you regarding estimate requests, appointments, project updates, customer service, and, where permitted by your consent and applicable law, promotional offers.Message frequency may vary. Message and data rates may apply.Consent to receive marketing text messages is not a condition of purchasing our services.You may opt out of SMS communications at any time by replying STOP. You may reply HELP for assistance.19. Governing LawThese Terms are governed by applicable law, without regard to conflict-of-law principles.Any additional dispute-resolution or venue provisions contained in a signed customer agreement will control for that particular project.20. Changes to These TermsWe may update these Terms periodically. Updated Terms will be posted on our website with a revised effective date.Continued use of our website or services after changes become effective constitutes acceptance of the updated Terms to the extent permitted by law.21.
